Video Telephone Policy

Company recognises the need to strike a balance between an individual's right to be free from invasion of privacy and Company's duty to promote a safe environment for all employees and wider community members whilst protecting Company property.

Mobile or Cell phones with video, still picture and voice recording capability are now available in the community. It has been recognised that individuals may be able to use this technology to breach Company policy or possibly undertake criminal activity.

This policy has been developed to comply specifically with the Freedom of Information and Protection of Privacy Act, applicable Federal legislation, and to be consistent with other related Company policies.

It is also recognised that some parts of Company have unique needs and practices. While these requirements will remain, it is necessary to standardise our procedures so all employees of Company and members of the wider community have an expectation of consistency, regardless of where the equipment is used.

Purpose

The purpose of this policy is to:

  1. Improve personal privacy of individuals by:
    • Deterring people from filming other individuals illegally; and
    • Increasing the likelihood of identification of person(s) who may commit acts that contravene this policy;
  2. Assist with the application of Company policies with regard to the security and protection of Company property and materials and the property of others located on Company premises;
  3. Assist law enforcement agencies with regard to the investigation of any crimes that may be carried out.

Limiting Use Of Video Telephones

At no time will a person film or record individuals on the premises of Company without his or her written consent. This consent does not extend to areas of Company where confidential or sensitive information is stored. Personal information contained on the recordings shall not be used or disclosed for purposes other than those for which the individual filmed has agreed to in writing, except as required by law.

At no time will a person film or record individuals on the premises of Company in:

  • Bathrooms, shower rooms or toilets;
  • Changing rooms or any place where a person is disrobed;
  • First Aid rooms;
  • Any area sign posted with words such as 'Private' or 'Authorised Personnel'
  • Any area used for or by security personnel;
  • Any enclosed office.

All employees who are on Company premises and in possession of a video phone or phone capable of recording film and sound will make these devices immediately available for inspection upon request by management or security.

Reporting Of Policy Abuse

Where an employee suspects a person of filming or recoding in contradiction of this policy, they are obligated to immediately report it to their Manager or person responsible for security with information pertaining to:

  • The alleged individual concerned
  • The location of the alleged incident
  • The time of the alleged incident
  • The alleged subject matter

Company will investigate all allegations of contraventions of this policy. In the event that the matter involves an employee alleged to have breached this policy, that employee may be suspended with pay during which time an investigation shall be completed.

Any employee involved in an allegation of policy breach and who owns or is in possession of a device capable of recoding image and/or sound shall make available to Company any telephone records that can assist in determining the allegation. These records may only be used specifically to deal with the allegation and must be returned to the employee at the completion of the investigation.

Contravention Of Policy

Any employee found to have breached this policy will be formally disciplined and may be dismissed.

Any employee found to have breached this policy may have the matter and any associated evidence turned over to the Police for further determination as to whether a crime has taken place.

Any employee found to have breached this policy by transmitting Company confidential information without appropriate written consent may have legal action taken against them by Company.
